Jul 6, 2021 The evidence of Maoist links that led to Stan Swamy's arrest may have been planted, a new report finds.
Prime Time With Ravish Kumar: Bhima Koregaon Case

Stan Swamy- "Govt. wants to remove me from the way!.." June 13, 2019 https://www.youtube.com/watch?v=ND-DA_QyIEA
The immense mineral and forest wealth of Jharkhand has always been the vulture vision of corporate enterprise houses. Their nexus with the government has been proving to be. The owners of the plots here are simple tribal people. Many people like Stan Swami have been fighting for the cause of these tribals for a long time. Obviously they are a big obstacle in the path of the government and the corporate arbitrariness. That's why Stan Swamy is saying:
'Government wants to throw me out of the way.. There is no evidence against me in Bhima Koregaon violence, yet the police is unnecessarily harassing me.'
What else Stan Swamy said:
The High Court has clearly said that the police do not have evidence against me.
The case against me started when I filed a petition in the High Court against the government against the innocent tribals lodged in the jails of Jharkhand.
The government is trying to divide the tribals, in the name of Sarna and Christian .. even inciting them to struggle against each other..
Most of the tribal MLA MPs have been sold.
- No more trust in the lower court, hope from the higher courts!
Who is the 82-year-old Stan Swamy, who has been living among the tribals of Jharkhand for three decades? ..know in this exclusive interview.
82-year-old Fa, who fought in the interest of tribals. On June 12, Maharashtra Police again raided the residence of Stan Swamy in Namkom (Ranchi). Even before this, last year on August 28, 2018, Maharashtra Police had raided Stan Swamy's place. The case is related to the Bhima Koregaon violence in Pune. Fact Fold this time in a long conversation with Stan Swamy, trying to know why the police are behind him?
Police efforts are on to connect the Bhima Koregaon violence with Ranchi, the capital of Jharkhand. In January 2018, the police arrested several suspects in the Bhima Koregaon case in Pune, Maharashtra, ranging from P Varavara Rao to social activists such as lawyer Sudha Bharadwaj, Sudhir Dhawale, editor of the political magazine Vidrohi, human rights lawyer Surendra Gadling Social activist Mahesh Raut, Nagpur University professor Shoma Sen and Delhi-based social worker Roma Wilson are still behind bars.
In the Bhima Koregaon case, in August last year, the Maharashtra Police also raided the residence of Father Stan Swamy, a well-known human rights activist from Ranchi. After a long interrogation, the police had confiscated his laptop and some papers. After this incident, Stan Swamy appealed for justice in the Mumbai Court. The matter is under consideration. But in the meantime, once again, threats came at the residence of Pune Police Stan at 7:30 in the morning at Namkom. The news spread like fire in the city. Media cameras, including Father Stan's well-wishers and fellow workers, reached. Everyone was apprehensive that this time the police might not arrest Stan. After about four hours of long interrogation and raids, the police returned. And this time also Stan took many of Swami's papers and hard disk of his computer with him.

Justice Shinde said "If you don't have faith in the system, why approach the court?" https://www.livelaw.in/top-stories/bombay-high-court-takes-objection-lawyers-article-criticizing-handling-stan-swamy-bail-case-175185
(Comment: Do we have any other option? When given the circumstances, the power is with the court, whether we have faith or not, is not an issue. It is the option given by law, ...Yet we keep hearing many litigants keep saying "that they have full faith in the judiciary", I wondered why. This only happened with the Lord of yore!)
At the cost of repetition, I don't read news reports because of lack of time. But in this case, there was a discussion. Why come before us if you don't have faith in us? So many matters regarding freedom of speech and expression, which we have heard and allowed. Keep faith in us and in the system. We are here to do justice, unafraid of anyone."
Chaudhry was quick to add, "It is only because we have faith in the court that we come to the court. But sometimes, the court lets down the faith we have in it." Vehemently defending his junior's actions, Chaudhry said that neither he nor his junior had represented Swamy. And he would continue to write and also seek relief from the court. "If I am writing articles while arguing the same matter, then I or anyone from my chamber will rightly stand rebuked," he said, adding that the courts can be criticised for their decisions.
In response, Justice Shinde said he was not against freedom of speech and expression, but Swamy's bail plea was sub-judice. Moreover, the advocate may not have represented Father Swamy, but most of the Bhima Koregaon - Elgar Parishad Case matters are on a similar footing.
Comment2 : If the entire case of all the Bhima Koregaon case is on a "similar footing" cant we expect the court to take a holistic view of the matter, when it seems that court after court keep passing judgements in the narrow immediate plea.

A teachers who has worked for making the University, a safe better inclusive space. Who has tirelessly worked for marginalised students,
Has given court cases, worked with lawyers , against discriminatory practices. for examplein DU there was the practice of having two different kinds of forms one for the general category and one for the SC/ST category. and there was this practice that ST/ST student could not apply to DU from outside Delhi. They had to come to Delhi show their certificate and get the borchure.. but other students could do it from anywhere. Babu, worked with the SC/ST welfare non teaching organisation and worked on a legal case, which they won and now the system has changed. Doing all this agitation, he even took a law degree. Here is a committed person.

Bar & Bench @barandbench
Vacation Court Bench led by Justice SJ Kathawalla of BombayHighCourt to hear the application of Father Stan Swamy seeking bail on medical grounds in connection to the #ElgarParishadcase of 2018.
On Wednesday Taloja Central Prison authorities were directed to produce Swamy for the hearing in Court through video conference. https://www.barandbench.com/news/litigation/bhima-koregaon-stan-swamy-produced-vc-taloja-jail-bombay-high-court
Bombay High Court directs Taloja Jail authorities to produce Father Stan Swamy before it via video...
Sr Adv Mihir Desai will appear for Swamy. ASG Anil Singh will appear for #NIA
Fr Stan Swamy can be seen in the VC hearing.
Court is reading the medical report.
Court asks if Desai is given a copy.
Desai denies.
Court reads out the medical report for him and states that there are some medicines given to him.
Court speaks to Stan Swamy through VC.
Court: Mr. Swamy can you hear us?
Swamy answers with a feeble hello.
Court: You were examined by the doctors?
Swamy: I am in Taloja jail.
Court: Were you examined by doctors from JJ Hospital?
Swamy: Yes, yesterday I was examined in several places. What I want to say is how I am.
Swamy: I was brought here 8 months ago. When I came here, full system, my body was very functional. But during this 8 months, there has been a steady but slow regression of my bodily functions. So the main issue is.. (takes a pause)
Swamy: 8 months go I could take bath by myself, some writing by myself. But these are disappearing one after another.
So (takes a pause) Taloja jail, brought me to a situation where I can neither write or I can go for a walk by myself. Or eating.
Swamy: I am not able to meet this demand. Eating is also in a difficulty. Someone has to feed me with a spoon. I am asking you to consider, why and how this regression of myself. Like yesterday I was taken to JJ hospital and so there was lot of people but I had no opportunity
Swamy: .. to explain what I should be given. There are some medicines which the jail authorities have given me, but this, my deterioration is so powerful than the tablets they are giving me. So I have come to you. Before I used to put my earphones, any conversation I was able
Court (to Desai): He is not wanting to go to any hospital.
Desai: Can he be admitted to some private hospital for 10-12 days?
Court: But he is saying no to any hospitalisation.
Swamy can be heard saying - I would ask for interim bail.
Court: Whom is he talking to?
Desai: Two things. The situation in Taloja prison jail. He is in prison hospital. The problem is they have nothing. They have no MBBS doctors.
Desai: this has been argued before other benches too.
Court: So this is not the problem with JJ hospital. But he is saying no.
Desai: I do not have a problem with that. But if it meets your lords, can I speak to him and see.
Court permits Desai to speak to Swamy in their presence.
Court: We find the general ailments are due to old age, which will be treated in JJ while he is admitted.
While the court is trying to connect to Taloja, Court dictates order.
Order records all ailments considered by the committee of doctors appointed.
Order: We have spoken to Swamy and we have observed that he has a severe hearing problem. He is able to hear only if a person is able to sit next to him conveyed to him our question.
Swamy is connected to the VC.
Desai tries to speak to him.
Swamy: Mihirji, the only thing I request is to consider for interim bail. That is the only request.
Desai: Fr Stan, I am only saying is, question of bail will be decided later. Right now, only to take care of immediate health, just get admitted to hospital, JJ or other hospital. Someone close to you, can visit you there. Your health can first improve and then the interim bail can be decided.
Swamy: I have been to JJ hospital twice. I have been in deteriorating condition. I would rather be in Ranchi.
Desai: Right now it may not be possible to send you to Ranchi. If you are admitted to Holy Family Hospital for some time, will you be fine?
Swamy: I do not think any of that is going to help. This is not going to make any difference. My condition is deteriorating. Whatever happens to me I want to b..
Court records that he does not want to be treated at any hospital. He insists he should get interim bail.
Order: in view of above standoff, Desai states that matter be kept after a few days, while he has a talk with Fr Swamy.
Order: We are placing matter on June 7
Taloja jail to strictly follow the recommendations and treatment advised and facilities to be provided set out in the report of the committee in May 20, 2021.
Desai: since he is a priest, he has this approach that forgive them and let me suffer. So please grant me liberty to move.
Court: He suffers from age related problem. You do not need liberty for that. He was also pressing for interim bail.
Court: He is an intelligent man, he was also pressing for interim bail because he knows he is suffering from age related problems.
Desai: Let me try and convince him.
Court: You try and convince him if you can. You do not need liberty to move the Court.
Hearing ends.
KS: I think Father Stan is in a satyagrah like situation. Not wanting hospitalisation when everyone seemed to be urging, When the patient himself said my condition has deteriorated. Nothing short of Home, Ranchi. I would personally support such a resolve like we do when people sit on a fast unto death. Prevent forcible administration of glucose. However, the whole attitude of Courts towards prisoners is not towards their rights.
RYJ:
Fr. Stan swamy interpretation is a lesson that prison authorities judiciary, HR activists and politicians to learn. he is real HR activist and a Saint.
KS in socila media: Yes, that is what I was trying to say, he wants to make them realise, that he does not fear hardship for himself, though he cannot stand, sit, eat or drink himself, needs support, will take that suffering, but will be firm on truth.
https://www.livelaw.in/top-stories/stan-swamy-interacts-with-bombay-hc-for-interim-bail-bhima-koregaon-case-174477 'I Would Rather Suffer, Possibly Die Very Shortly If This Were To Go On' : Stan Swamy Pleads For Interim Bail In Bombay HC"Whatever happens to me, I would like to be with my own" ( meaning Adivasis of Jharkhand), he said Eight months ago, I would eat by myself, do some writing, walk, I could take bath by myself, but all these are disappearing one after another. So Taloja Jail has brought me to a situation where I can neither write nor go for a walk by myself. Someone has to feed me. In other words, I am requesting you to consider why and how this deterioration of myself happened. Yesterday I was taken to JJ Hospital, so I got an opportunity to explain what I should be given. My deterioration is more powerful than the small tablets that they give"
M: in Social Media: It's a sad commentary on our judiciary that the judge did not see his extreme debility as a fit reason for bail, inspite of stan lucidly pointing this out
