Democratic Institutions
Rahul Gandhi said that he has “no hatred for either Modi or RSS…because there is no fear in my heart. It is fear which creates hatred and division. So I will tell BJP, Modi, Amit Shah, RSS people…brothers, erase the fear; your hatred will disappear; your fear is causing damage to the country.”
In a statement issued on the occasion of Constitution Day, Kharge said “The Constitution that has successfully stood the test of time for over seven decades…faces a fundamental crisis, indeed an existential crisis for the spirit behind its text,” he stated.
“This crisis finds its roots in RSS’s ever-expanding reach within state institutions and the electoral (and by extension judicial) legitimacy of its ideology, with BJP being in power since 2014. ...
“Since coming to power, RSS has used the BJP as a political vehicle on every opportunity to curtail freedoms, enshrined in the Constitution."
While giving bail to Shiv Sena leader Sanjay Raut on November 9, a court in Mumbai made scathing observations about the Enforcement Directorate, accusing the agency of selectively arresting individuals. The court also noted that the Enforcement Directorate has a tendency to arrest an accused person immediately but is then slow to prosecute them.
There have been several such instances recently where courts have criticised the agency for its investigation process. This criticism from the court comes after Opposition leaders and civil society members have condemned the central agency for using it vast powers under the Prevention of Money Laundering Act, 2002 to allegedly targets critics of the ruling Bharatiya Janata Party.
Parliament, CAG, EC: More Pillars Crumble as Modi Tightens Hold https://m.thewire.in/article/government/parliament-cag-ec-more-pillars-crumble-as-modi-tightens-hold The parliament’s fall as an institution of functioning democracy was accompanied by axe on the Election Commission and CAG.
A very remarkable analytical account of the thorough hollowing out of the institutions of the parliament, the EC and the CAG by the Modi regime, especially since 2019, in the process of piloting India to the goal of a Putinist model of Democracy -- Democracy with all its imposing formal paraphernalia but thoroughly stripped of their very souls.
Shiv Sena MP Sanjay Raut was released from jail on Wednesday, hours after he was granted bail by a court in an alleged money laundering case filed by the Enforcement Directorate (ED) that was sharply rebuked for arresting the politician "illegally" with a "pick-and-choose attitude". He emerged from the Arthur Road Jail in central Mumbai to a huge welcome from members of the Uddhav Thackeray faction of the Shiv Sena, waving a saffron scarf from the sunroof of an SUV. 115,068 views Sep 5, 2022 Prime Time With Ravish Kumar - September 5, 2022:
Mahua’s “Goonda” Dig As Deoghar DM Charged With Sedition Post Twitter War With BJP’s Nishikant Dubey https://www.youtube.com/watch?v=jhjb4OKQIZQ Sep 3, 2022 BJP’s Nishikant Dubey and Manoj Tiwari have been booked for allegedly forcing flight take-off at Deoghar airport in Jharkhand.
A case has been registered against 9 persons including both BJP MPs and the airport director. They have been charged with criminal trespass and endangering the safety of others.
As per the FIR, the named persons entered the high-security Air Traffic Control also known as ATC area at Deoghar airport without permission and forced officials at the Deoghar airport to clear their chartered flight for take-off.
What started as a violation of airport norms, turned into a war of words on Twitter in no time. BJP MP Nishikant Dubey got into a Twitter spat with Deoghar District Magistrate Manjunath Bhajantri.
Delhi Police has now registered a Zero FIR against Deoghar DM Manjunath Bhajantri on a complaint by BJP MP Nishikant Dubey. The IAS has been slapped with charges of sedition and other sections.
A day after Jharkhand Police lodged an FIR against BJP MPs Nishikant Dubey and Manoj Tiwari, Dubey’s two sons and others, saying they “forcefully” took flight clearance on August 31 from the Air Traffic Control at Deoghar airport, which is not yet ready for night operations, Delhi Police filed an FIR Saturday on Dubey’s complaint. It invoked the sedition charge against the Deoghar Deputy Commissioner and Jharkhand police officers for “playing with national security” by entering a “restricted” area of Deoghar airport.
The ‘zero FIR’, which Delhi Police sent to the Kunda police station in Deoghar for investigation, stated: “MP Nishikant Dubey, Chairman, Deoghar Airport Advisory Committee has lodged a complaint at P.S. North Avenue (11.34 am September 3)… Prima facie offences under IPC section 124A (sedition), 353 (assault or criminal force to deter public servant from discharge of duty), 448 (house trespass), 201 (causing disappearance of evidence), 506 (criminal intimidation),120B (criminal conspiracy) and Officials Secrets Act.”
