Maharashtra ranks 9th with 17 judges per million. Vacancy among HC judges here is 27.7% (lowest is Kerala at 4.3%) but in subordinate judiciary only 11.4% of posts are vacant. Despite such low vacancies among district judges, 40% of all cases in district courts are pending for over three years.
Maharashtra also ranks poorly on diversity indicators across the law and judiciary wings. It has among the worst representation of STs in judiciary with actual representation to reserved ratio in posts pegged at 5%. The India Justice Report was first initiated by Tata Trusts, with the first-ever ranking published in 2019. The collaboration is with the Centre for Social Justice, Common Cause, Commonwealth Human Rights Initiative, DAKSH, TISS–Prayas, Vidhi Centre for Legal Policy, and How India Lives, IJR's data partner. The report is based on 24 months of research on performance of states on delivery of justice and mandated services. The report also assesses capacity of State Human Rights Commissions and explores mediation and access to justice for persons with disabilities.
